property disputes: case examples

Chris was the mediator in a £480,000 dispute between competing chargeholders for a property whose owner defaulted. The issues were around the priority of mortgages, subrogation and certain equitable remedies.  Claim settled at mediation.

Chris was the mediator in a landlord’s £90,000 dilapidations claim against a tenant of a unit on an industrial estate. Interestingly the unit-holder’s defence was not just quantum, but also entitlement – the repair covenant position was unclear. Agreement reached at the mediation about liability, with parties’ surveyors to meet later to agreed quantum.

Chris was the mediator in a £450,000 property dispute between two couples, one couple alleging a 50% share in a London property bought many years earlier. Although there were involved discussions around a cash payment, agreeing practical arrangements for the sale of the property and division of the sale proceeds was the key. Claim settled at the mediation.

Chris was the mediator in a very acrimonious and long-running neighbour/building dispute. BTE insurer issues in relation to costs. Claim settled at mediation.

Chris was the mediator in a £300,000 construction dispute between a land developer and the property’s previous owner.  The issues were around whether mains services had been connected, and other works.  The case involved a back to back sale to a housing association.  Claim settled at mediation.

Chris was the mediator in a Mosque dispute between two rival factions within the Bengali community. Difficult (and almost exclusively non-monetary) issues of public law in issue. Substantial progress made at the mediation towards finding resolution.
